Settlement Agreements – ACAS Consultation

An consultation on a new Code of Practice on Settlement Agreements has now been launched by the conciliation service, ACAS.  The deadline for comments is 9th April 2013.

The new legislation proposed to be introduced by the Government in the near future will effectively mean that any offers or discussions about Settlement Agreements cannot be used as evidence in an unfair dismissal claim unless either of the parties has engaged in some improper behaviour. The Code will explain what constitutes improper behaviour and will come into effect alongside the new legislative provision to assist everyone in the workplace with understanding how it will work in practice.
