Can my boss pressure me to sign the settlement agreement?

If your boss is putting pressure on you or threatening to sack you if you don’t sign the settlement agreement, then this is not acceptable and may be deemed improper behaviour. If it appears that this is the case, and you have resigned, then you could make a claim against your employer for constructive dismissal. If you don’t resign, but are then dismissed, you may then be able to make a claim for unfair dismissal.

The best thing to do, however, is obtain legal advice from an adviser qualified in employment law. This adviser will be able to explain what routes forward are available to you. You will then be in a position to make an informed decision without prejudicing your position.

Another way that your boss may put pressure on you to sign the settlement agreement is to refuse to give you a reference. Unfortunately, an employer has no legal obligation to give an employee a reference. However, it is a point for negotiation and you should therefore seek legal advice as soon as possible.
